Azerbaijan initiates criminal cases against some construction companies for labor law violations

The monitoring, carried out in the construction sector by the by the Center for Monitoring of Labor Relations of the State Agency for Citizens Service and Social Innovations under the President of Azerbaijan, revealed that 18 legal entities and 3 individuals had involved people in labor activities without concluding contracts. The Anti-Corruption Department under the Prosecutor General investigated 18 materials submitted by the Center for Monitoring of Labor Relations.

As a result of the investigation, criminal cases were initiated against three legal entities under Article 162-1.1 (employing a large number of workers without a labor contract in force) and 308.1 (abusing official powers) of the Criminal Code of Azerbaijan, the Prosecutor General’s Office told APA.

The investigation of the criminal case filed against the officials of "INV" LLC has been completed and sent to the relevant court to be reviewed, the investigation of the criminal case filed against the other two legal entities is nearing completion.

Administrative proceedings were initiated against 11 legal entities under Article 192.1 (violating the labor law) and one legal entity under Article 198.0.1 (violation of labor protection rules) of the Code of Administrative Offenses.

The collected materials were submitted to the State Labor Inspection Service Inspectorate under the Ministry of Labor and Social Protection of Population of Azerbaijan for consideration, individuals and heads of legal entities were officially notified in 12 cases. Nine submissions were sent to the Ministry of Taxes and 11 were sent to the Ministry of Labor and Social Protection for the purpose of eliminating law infringement and its causes. Currently, investigations on 5 legal entities and 2 individuals are underway.
