Intellectual Property Agency of the Republic of Azerbaijan has investigated the fact that the famous Azerbaijani composer Jahangir Jahangirov's musical work "Zərif gülüşlüm" was stolen and performed by Arutyun Ambukchyan and Seda Tadevosyan under the name "Garam dardzats" and shared on the YouTube platform, the Agency told APA.

According to the Agency, the musical work "Garam dardzats" (https://www.youtube.com/watch?v=Berg7dsldeI) coincides with the musical work "Zərif gülüşlüm" by the Azerbaijani composer Jahangir Jahangirov.

It was reported that the work "Zərif gülüşlüm" was registered at the Azerbaijan branch of the All-Union Copyright Agency (now the Intellectual Property Agency) based on Jahangir Jahangirov's application dated December 18, 1969, and was included in the relevant catalog.

According to the opinions of Azerbaijani composers Eldar Mansurov and Faig Sujaddinov, experts of the Intellectual Property Agency, it was determined that the song "Garam dardzats" performed is the same as Jahangir Jahangirov's "Zərif gülüşlüm". This means that the musical piece "Garam dardzats" performed by Arutyun Pambukchyan and Seda Tadevosyan is plagiarized, and the title of the famous Azerbaijani composer Jahangir Jahangirov's Zərif gülüşlüm" was changed to "Garam dardzats".

In the information given about the music piece posted on the YouTube channel by Arutyun Pambukchyan and Seda Tadevosyan, Jahangir Jahangirov's personal rights as an author were not mentioned, and his property rights were violated from the point of view of placing it on the YouTube channel for commercial purposes. Khachik Sahakyan is listed as the arranger in the information about the song on the YouTube channel. In terms of copyright legislation, the permission of the author or his heirs must be obtained for the arrangement of the song.

It is a gross violation of the provisions of the national legislation of Azerbaijan, as well as the Berne Convention "On the Protection of Literary and Artistic Works", the WIPO Copyright Treaty and the WIPO Performances and the provisions of the Treaty on Phonograms.
