Inquiry of the President of the Republic of Azerbaijan Ilham Aliyev to the Constitutional Court in connection with the constitutionality of the issue of dissolution the parliament, on the basis of decision of the Milli Majlis dated December 2, 2019 “On the appeal to the President of the Republic of Azerbaijan on appointment of early elections to the Milli Majlis of the Republic of Azerbaijan” is reviewed in the meeting chaired by Chairman of the Constitutional Court Farhad Abdullayev.
The meeting is attended by judge-rapporteur Rafael Gvaladze, secretary of the meeting Farid Aliyev, representative of the submitting party, department of legislation and legal policy of the Presidential Administration Gunduz Karimov, representatives of the responding party are deputies of the Milli Majlis, chairman of the Parliament Committee on Legal Policy and State Building Ali Huseyinli, Safa Mirzoev, head of the Milli Majlis’s Office, expert, associate professor of the Department of Law, BSU, Doctor of Philosophy Nasib Shukurov.

The inquiry of President of Azerbaijan Republic about the compliance of the dissolution of Azerbaijani Parliament with the Constitution of the Azerbaijan Republic will be considered at the meeting.
It should be noted that on December 2, President Ilham Aliyev sent a request to the Constitutional Court in connection with the constitutionality of the issue of dissolution the parliament, indicated in the appeal of the Milli Majlis “On calling early elections to the Milli Majlis of the Republic of Azerbaijan”.
The request says that "deputies of the Milli Majlis of the Republic of Azerbaijan adopted a majority voted to address the President of the Republic of Azerbaijan" On calling early elections to the Milli Majlis of the Republic of Azerbaijan." This decision expresses a request to the President of the Republic of Azerbaijan to dissolve the Milli Majlis and call early elections on the basis of Article 981 of the Constitution of the Republic of Azerbaijan.
The decision notes that the absolute majority of members of the Milli Majlis formed a position that it was impossible to carry out the parliamentary activity, as a result of which the continuation of parliamentary activity became impossible.
In this regard, in order to fulfill the Milli Majlis in accordance with modern challenges, the powers provided for in Articles 94 and 95 of the Constitution and ensure a high level of public confidence on the basis of the Decision, it is necessary to dissolve the Milli Majlis and hold early parliamentary elections.
Before making the final decision on the Decision of the Milli Majlis, it became necessary to find out the opinion of the Constitutional Court of the Republic of Azerbaijan on whether the dissolution of the Milli Majlis under the current conditions complies with Article 981 of the Constitution of the Republic of Azerbaijan.
Guided by the above and the first paragraph of part III of article 130 of the Constitution of the Azerbaijan Republic, I ask you in this situation to decide whether the Decision of the President of the Republic of Azerbaijan on the dissolution of the Milli Majlis on the basis of the Decision of the Milli Majlis of the Republic of Azerbaijan “On the appeal to the President of the Republic of Azerbaijan Of the Republic in connection with the calling of early elections to the Milli Majlis of the Republic of Azerbaijan.”
