Azerbaijani MP: “Pardoning of Ramil Safarov unambiguously within the legal framework of the obligations assumed by our state"

“On May 26 European Human Rights Court has made a decision in the case of “Makuchyan and Minasyan against Azerbaijan and Hungary”. In this case, some events have happened regarding the extradition of an Azerbaijani Army officer Ramil Safarov who sentenced to life imprisonment, from Hungary to Azerbaijan” the member of Parliament Nizami Jafarov said at today’s meeting of Milli Majlis, APA reports.

He said that the decision of European Human Rights is not a coincidence and preparations for it have started many years ago: "In fact, biased resolutions of the European Parliament on the issue of Ramil Safarov of September 13, 2002, and PACE of November 18, 2014 “On measures to prevent abuse The Convention on the Transfer of Sentenced Persons ”gave the green light for a decision of the ECHR, which goes beyond the framework of case law."

The MP noted that when Azerbaijan acceded to the European Convention, in accordance with the requirements of Article 19 of the Vienna Convention on the Law of Treaties of May 23, 1969, it made a reservation on Article 12: "According to that reservation, The decision on pardon and amnesty for a convicted person from Azerbaijan must be agreed with the relevant authorities of Azerbaijan. No such provision has been made by Hungary under the Convention. In this regard, I can note with full responsibility that the pardon decree issued by Mr. President on August 31, 2012, based on paragraph 22 of Article 109 of the Constitution of Azerbaijan, unequivocally follows from the international legal agreement and unambiguously within the legal framework of the obligations assumed by our state."
