Azerbaijani President sends request to Constitutional Court to make a decision regarding dissolution of the parliament

President of the Republic of Azerbaijan on December 2 has sent a request to the Constitutional Court regarding the constitutionality of the issue of the dissolution of parliament, as stated in the request of the Milli Mejlis “On the appointment of early elections to the Milli Majlis of the Republic of Azerbaijan”, APA reports.

The request reads:

"The Parliament of Azerbaijan Republic has adopted by a majority vote of MPs the Decision “On making an appeal to President of Azerbaijan Republic about calling of the early election to the Parliament of Azerbaijan Republic”. By the mentioned Decision, the President of Azerbaijan Republic is asked to dissolve the Azerbaijani Parliament and to call early election based on clause 981 of the Constitution of Azerbaijan Republic.

Reelection of deputies by citizens of the country is necessary, taking into consideration the existence of determined positions of the absolute majority of Milli Majlis deputies on the impossibility of realization of Parliament’s activity and prevention of Parliament’s activity by itself. As Milli Majlis is not able to execute its powers anymore, it considers that Azerbaijani Parliament should not fall behind wide-range institutional and staff reforms, conducted in the country, and should rearrange its activity. That is why Milli Majlis should be dissolved and early parliamentary elections should be held in order to execute powers, noted in the Articles 94-95 of the Constitution of Republic of Azerbaijan, in accordance with modern calls and regain people’s reliance.

Before making a final decision on the decision of the Milli Majlis, it is necessary to learn the position of the Constitutional Court of the Republic of Azerbaijan on whether the dissolution of the Milli Majlis is in accordance with Article 981 of the Constitution of the Republic of Azerbaijan.

Guided by the above and the first paragraph of part III of article 130 of the Constitution of the Azerbaijan Republic, I ask you in this situation to decide whether the Decision of the President of the Republic of Azerbaijan on the dissolution of the Milli Majlis is consistent with the Constitution of the Republic of Azerbaijan on the basis of the Decision of the Milli Majlis of the Republic of Azerbaijan “On Appeal to the President of the Republic of Azerbaijan Of the Republic in connection with the calling of early elections to the Milli Majlis of the Republic of Azerbaijan."
