Criminal responsibility of Azerbaijani citizen for not reporting of adoption of foreign state

“The citizens of the Azerbaijan Republic who adopted citizenship of foreign country in the past didn’t report this fact to the concerned agencies, and proceeding from this necessity, the clause 318-2 was included in the Criminal Code”, said the member of Legal policy and state building committee of the Azerbaijani Parliament Kamal Jafarov
in his statement to APA.

K. Jafarov said then the goal was to make people more responsible: “Currently, there are relevant forms of appeal, and the present practice shows that the persons who adopted citizenship of foreign country submit timely the information about this to the Migration Service and the Ministry of Foreign Affairs. In this connection, there is already no need in taking strict measures in regard to the mentioned issue”.

In this connection, it has been envisaged in the proposed change to the law “About citizenship of the Azerbaijan Republic” to remove the sentence about bringing to responsibility according to the prescribed procedure of a citizen of the Azerbaijan Republic who adopted citizenship of foreign state and didn’t provide information about this to the Ministry of Foreign Affairs and the State Migration Service within one month.

Remind that the decree of the President of the Azerbaijan Republic “About deepening of reforms in judicial and legal system” dated April 3, 2019 reflects a number of issues aimed at improvement of quality and efficiency of the administration of justice. The decree assigns the task of preparation of relevant draft laws aimed at continuation of measures for humanization of penal policy and decriminalization of crimes.
