People detained while incident happened at Relax recreation center of the Lerik district have been brought to the court, APA reports.
According to the information released from press services of Ministry of Taxes, Ministry of Internal Affairs and Prosecutor General’s Office, despite the decrease in total numbers of tax inspections, Ministry of Taxes carries out tax control measures in cases of high probability of tax evasion.
Next such activity is planned to be taken part at the Relax recreational and tourism center at Lerik district on August 16. The reason for control measure was sharp reduction of taxes paid to the state budget by recreational center. Despite the fact that the recreational center consisted of 142 rooms for guests with 14 hectares of area where more than 20 objects of various purposes exist, 10726 AZN of taxes was paid in 2018, and just 972 AZN in the past period of 2019. Furthermore, despite the fact that the Relax recreation center has an integrated management system, objects here are formalized on behalf of different individual taxpayers for tax evasion purposes, number of centers didn’t registered in taxes authorities.
In addition, despite the fact that the center “Relax’ has a unified management system, in order to evade tax, the objects are designed in the name of individual taxpayers, a number of objects functioned without taking into account the tax authority. Taxpayers from the recreation center were repeatedly warned about the need to comply with the requirements of tax legislation, eliminate existing deficiencies and facts of tax evasion, but they ignored these requirements.
Therefore, to determine the real tax potential, it was decided to hold by the Territorial Tax Administration No. 6 of the Ministry of Taxes at objects owned by taxpayers in the recreation center for timekeeping and other operational measures for operational tax control.
On August 16, employees of the Ministry of Taxes, who arrived at the business entity to carry out control measures, encountered resistance and obstruction of their legitimate activities. Despite the measures taken to clarify and inform, the relevant decisions on the audit were made, the access of tax officers to the territory was not allowed. The intervention of the employees of the Lerik district police department, as well as representatives of the executive power of the Lerik region in the case, did not give positive results, people who identified themselves as officials of the Recreation Center attacked tax officers and police officers, injured them. In addition, cars that were in the use of the Ministry of Taxes service and in the personal use of employees of the Ministry were damaged with stones.
A criminal case has been launched on the case, an investigation team of experienced police officers and prosecutors has been created. In addition, officials of the Prosecutor General’s Office, Ministries of Taxes and Internal Affairs were sent to the district.
The Ministry of Internal Affairs of the Republic of Azerbaijan and the Prosecutor General’s Office take the issue under control immediately; public tranquillity has been restored by taking operative measures, and condition, necessary for conducting tax control by taxation employees in “Relax” Recreational Center, has been provided.
The scene has been reviewed, photos and videos have been taken by using criminalistic technical means on the criminal issue. The fixation has been performed on the site, material evidence has been taken, witnesses of the occurrence have been determined and questioned, medical-forensic, forensic-science of commodities, and forensic-trasological expertises have been conducted.
Narimanli Mirhamid Igbal, Narimanli Orkhan Chingiz, Shahverdiyev Rahim Bahlul, and Abbasov Amir Nagizade, executing organizational-manager and administrative functions of the Recreational Center, were involved to the court as the accused persons in accordance with 309.2 (Application of violence or with threat of its application, or with application of weapon or other special means, or entailed heavy consequences) and 315.2 (Application of the violence dangerous to life or health, concerning a persons specified in article) articles of the Criminal Code and arrest warrant was issued.
Department for Investigation of Grave Crimes of the Prosecutor General's Office of the Republic of Azerbaijan continues comprehensive investigative actions and operational-search measures aimed at identifying all the features of the criminal case, the circle of people whose actions contain signs of a crime.
Currently, in the centre of leisure and tourism Relax, all facilities are functioning normally, guests are relaxing quietly, at the same time, tax control measures are carried out as usual.
Note that the arrested Narimanli Mirhamid is the son of MP Igbal Mammadov.
