Criminal case initiated in regard to French citizen being member of ASALA terrorist organization and group headed by him

The implementation of necessary measures is continued by the General Prosecutor’s Office of the Republic of Azerbaijan in order to unmask once again the occupational nature of the Republic of Armenia on the international plain, as well as to bring to responsibility military servicemen of the provocateur Armenian units who committed crimes against our army and civilian population in the framework of norms of international law, the press service of the General Prosecutor’s Office told APA.

As the continuation of these implemented measures, the investigation was conducted in the General Prosecutor’s Office of the Republic of Azerbaijan based on the multiple pieces of information disseminated in local and foreign mass media outlets in regard to the criminal actions committed on the territory of the Republic of Azerbaijan by a member of ASALA terrorist organization, a citizen of the Republic of France Gilbert Minasyan who was repeatedly convicted for terrorist activity and the group headed by him and consisting of 15 people having military experience.

The grounded suspicions were determined by the investigations that a member of terrorist organization, a citizen of the Republic of France Gilbert Minasyan acting together with other members of the group headed by him and consisting of 15 people having military experience made criminal dealing with persons being in Armenia and on the occupied territories of the Republic of Azerbaijan and united with them as members of the criminal association and in contradiction to requirements of the Law “About state border of the Republic of Azerbaijan” and the Migration Code and illegally crossing the state border recognized at international level based on the resolution #822 of Security Council of the United Nations Organization dated April 30, 1993, #853 dated July 29, 1993, #874 dated October 14, 1993, #884 dated November 12, 1993 without prescribed documents and in the area far from entry control points of the state border i.e. from Armenia’s territory arrived in Khankendi City and other residential settlements being under occupation, and were used by political and military regime of the Republic of Armenia as mercenaries in the military conflict and the aggressive war directed against peaceful citizens of the Republic of Azerbaijan and the armed forces implementing anti-terrorist operations, as well as aimed at occupation of territories of the Republic of Azerbaijan in order to support the illegal regime functioning under the title of “Nagorno Garabagh Republic”.

Besides, the grounds for suspicions were determined via investigations that those persons participated in terrorist activity against citizens of the Republic of Azerbaijan using fire arms, combat mmunitions and component parts acquired by them illegally.

Also the facts that the mercenaries being citizens of foreign countries used the weapons and ammunitions brought by them illegally against the Azerbaijani Army found its confirmation in the proofs collected through investigative actions conducted by employees of prosecutor’s office on the territories liberated from occupation as far as the enemy was retreating.

The criminal case was initiated into this case by General prosecutor of the Republic of Azerbaijan based on clauses 100.2 (waging of aggressive war), 120.2.1 (deliberate homicide by criminal association-organization), 120.2.4 (deliberate homicide with special cruelty or by commonly dangerous method), 120.2.12 (deliberate homicide with intention of national, racial, religious hostility or animosity), 214.2.3 (terrorism), 279.3-cü (establishment of armed groups not envisaged in legislation) and other clauses of the Criminal Code of the Republic of Azerbaijan and implementation of the investigation was assigned to Investigation Department of the General Prosecutor’s Office.

The requests for legal assistance were sent by the General Prosecutor’s Office to the authorized institutions of the country whom the aforementioned persons are citizens of.

Currently, the intensive investigative and operational measures under this case are continued.

As was informed previously, the investigative and operational measures are also continued under the criminal case initiated in regard to a citizen of the Republic of France Arthur Oganisyan and a citizen of Georgia Vaagn Chakhalyan who committed criminal actions of the same content.

It is declared by the general prosecutor’s office of the Republic of Azerbaijan that “any law adopted” in order to legalize use of mercenaries and terrorists by the so-called regime established on our occupied territories being contradictory to norms of international law doesn’t exempt from criminal responsibility the persons who committed actions of this kind.
