Azerbaijan's Ombudsperson proposes amendments to the Criminal and Family Codes to eliminate early marriage problems

The Ombudsperson of the Republic of Azerbaijan has made proposals in order to eliminate problems of early marriage, the proposal is reflected in the report of the Human Rights Commissioner of Azerbaijan (Ombudsman) for 2019, which was included in the agenda of the plenary meeting of the Parliament scheduled for April 24, APA reports.

The report notes that in article 152 of the Criminal Code it is advisable to replace the words “sixteen years” with “eighteen years”. In this case, punishment for sexual contact or the commission of other acts of a sexual nature with a person under the age of 18 must be determined.

The report notes that the prevention of early marriage and premature pregnancy, informal marriage remains a serious problem in ensuring women's rights.

Human Rights Commissioner believes that young girls who are not ready physiologically and psychologically to become mothers cannot receive education and lose the opportunity to defend their rights, realize their physical and mental potential.

Ombudsperson proposed amending the Criminal and Family Codes to address the issue of early marriage. Currently, according to article 152 of the Criminal Code, sexual intercourse or other acts of a sexual nature with a person under the age of 16 are punished with imprisonment for up to 3 years. At the same time, responsibility for these crimes occurs if the age difference with the victim is more than 2 years.
