Court continues trial of Taleh Baghirov and others

Baku. Shahriyar Alizade – APA. The Baku Court of Grave Crimes on Oct.19 resumed the trial of Taleh Baghirov, Fuad Gahramanli and others.

At the hearing presided over by judge Alovsat Abbasov, defendant Abbas Huseynov said that he has been kept in a penalty isolator for five days and he doesn’t know the reason.

Later, imprisoned Rasim Bunyatov testified at the hearing.

He said that when he returned back home, he saw the police entering Abulfaz Bunyatov’s house: “They were shooting. They threw something, it exploded and smoked. Then we were taken to the Main Directorate for Combating Organized Crime.”

Then imprisoned Urfan Nabizade testified as a witness.

In response to the lawyers’ questions, Nabizade said that the police officers hadn’t presented any documents when they came to his house. He added that the grenade, bullets and weapons which were found in his house during the search operations, don’t belong to him.

Lawyer Yalchin Imanov said that the injured Bahruz Guliyev, Shamil Abdulaliyev and others were taken to the hospital by the township residents, and presented a photo related to the fact to the court. He asked the court to add the photo to the case materials. The court sustained the motion.

Lawyer Fariz Namazli asked the court to terminate the police officers’ status of ‘aggrieved persons’.

Commenting on the motion, the public prosecutor said that the matter has been discussed several times: “The lawyers filed the motion once again, putting the matter into discussion. However, my position hasn’t changed. The investigative body came to the conclusion that they were damaged. Not all evidences have been investigated yet. This matter can not be discussed now. If a decision is passed in regard to this matter, the court will have clarified some issues.”

The court rejected the motion. It stated that it is not right to pass a decision in this regard in the current stage. The judge mentioned that a motion can be filed again upon investigation of all documents.

Later, Yusif Gurbanov, an employee of Sabunchu District Police Department gave testimony. He said that on November 5, 2015 when he was on duty in the area, he saw Elchin Gasimov leaving the mosque and coming back home. Gasimov swore at him. After this, he took Gasimov to the department.

Taleh Baghirov said that the witness gave false testimony.

The process will be resumed on October 21.

Taleh Baghirov faces charges under Criminal Code’s articles #120 (premeditated murder), 120.2.1, 120.2.3, 120.2.4, 120.2.7, 120.2.12, 29, 120 (attempt to premeditated murder), 29,120.2.1, 29,120.2.3 , 29,120.2.4, 120.2.7, 120.2.12 , 228.3 (illegal purchase of firearms), 228.4 (illegal carrying of weapons) and others. On November 26, 2015, law enforcement agencies conducted a special operation in Nardaran township, Baku, arresting Taleh Baghirov and 60 others. Separate criminal proceedings were initiated against some of them and their criminal cases were sent to the Sabunchu district court, which passed verdicts against them.

Fuad Gahramanli was jailed for three months on December 8, 2015. He is charged under the Article 281.1 (public calls for the violent seizure of power) and 283 (inciting national, racial, social or religious enmity and hatred by using violence or threat of violence) and 220.2 (Appeals to active insubordination to legal requirements of representatives of authority and to mass disorders, as well as appeals to violence above citizens) of Azerbaijan’s Criminal Code.
